This policy explains how Inspire Kindy Photography collects, uses and protects information, and sets out the terms that apply when you use our website and photo ordering services. By accessing our site or placing an order with us, you agree to the terms set out below.
1. Who we are and how to reach us
Inspire Kindy Photography provides childcare and kindergarten photography services, including individual portraits, group and class photos and graduation photo day sessions. Photographs are uploaded to our online gallery, where families can view and purchase images of their own child or children.

Please keep the contact and account details you give us up to date, and let us know as soon as possible if anything changes. You must be 18 years or older to create an account or place an order with us. We may ask you to confirm your identity or your relationship to a child before completing an order, and we may suspend access to an account if we reasonably believe it is being used inappropriately or unlawfully.
We review and update our services and this policy from time to time. Any changes take effect once they are posted on our site, and continuing to use our services after that means you accept the updated terms. We recommend checking back periodically.
2. Use of photographs and content
When you purchase a photo from us, we grant you a personal, non-transferable right to use that image for your own private, non-commercial purposes, such as printing for family or sharing with relatives. Copyright in every photograph, along with our website design, branding and all other content on our site, remains the property of Inspire Kindy Photography and may not be reproduced, sold or used commercially without our written consent.
3. Privacy and data protection
We take your privacy seriously and handle personal information in line with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
Information we collect: When you register, enquire or place an order, we may collect your name, contact details, your child's name and centre and payment and order information. This information is used to deliver our photography services, process orders, communicate with you and your child's centre and for general business and statistical purposes.
Marketing communications: We may occasionally use your details to let you know about upcoming photo days, offers or new services. You can opt out of these communications at any time by contacting us or using the unsubscribe link in our emails.
Cookies: Our website may use cookies to recognise returning visitors and improve your browsing experience. These do not identify you personally, and you can adjust your browser settings to refuse cookies, though this may affect how the site functions.
Photo consent for marketing: As part of your registration, we will ask whether you are happy for photos from your child's session to be used on our social media, website or promotional materials. You can say yes or no, and we will never publish a child's name or centre location alongside a shared image.
4. Our commitment and your responsibilities
We take reasonable skill and care in providing our photography and online ordering services, but we cannot guarantee that our website will always be free of technical faults or security threats, so please take your own reasonable precautions, such as keeping your device software and antivirus protection up to date.
When using our site, you agree not to upload or transmit anything unlawful, defamatory, obscene, harmful to minors or infringing on someone else's rights, and not to use our services to send unsolicited messages, collect other people's information, interfere with our systems or attempt to gain unauthorised access to accounts or networks.
5. Liability
To the extent permitted by law, Inspire Kindy Photography is not liable for indirect or consequential loss, loss of data or business losses arising from your use of our services. Nothing in this policy limits our liability where it cannot be limited by law, including in cases of death or personal injury caused by our negligence.
We produce all photographs to a high standard using quality materials, however printed photographs and digital files may fade or degrade over time, particularly with sun exposure. We recommend using a professional print lab for the best and longest-lasting results, and we are not responsible for deterioration once photographs are printed or downloaded.
6. Consent for photographing children
Childcare centres and kindergartens are responsible for obtaining consent from parents and guardians before photo day, or for giving families the opportunity to opt their child out of being photographed. It is the centre's responsibility, not ours, to confirm that appropriate consent is in place for each child photographed.
By using our service, you confirm that:
● You will only purchase photographs of children you have a genuine connection to, such as your own child, a family member, or as a gift for someone with that connection. We may ask you to confirm this connection and can decline an order if we are not satisfied.
● We keep purchased and unpurchased photographs on file for 12 months, after which they are archived or deleted. Images that do not meet our quality standards are removed straight away and are not included in galleries.
● Copyright in all photographs belongs to Inspire Kindy Photography. Purchasing a photo gives you a right to use it personally as set out in section 2, but does not transfer ownership or copyright to you.
7. Payments, pricing and refunds
Prices shown on our site and in your cart include GST. Delivery is complimentary to your child's centre when orders are placed before the closing date shown on your photo day flyer or communications. Orders placed after the closing date, or requiring delivery to a home address, may incur a postage fee of $18.00 to cover this cost.
Prices may change from time to time, but any change will not affect an order you have already placed and had confirmed. Please check your order carefully before checking out, as we are unable to offer refunds or cancellations once an order has entered production, given photographs are personalised and have no resale value. Digital downloads cannot be refunded once delivered. If you believe there has been an error with your order, please get in touch and we will do our best to help.
8. Getting in touch and other website links
Any notices relating to this policy can be sent to us at the email address in section 1, or to you at the contact details you have provided us. Our website may occasionally link to third party sites for your convenience; we are not responsible for the content or practices of those sites, and including a link does not mean we endorse them.
9. Ending access to our services
We aim to operate fairly and reasonably, but we may suspend or end your access to our services if we consider that you have breached this policy or behaved in a way that could harm our business or reputation.
10. Resolving disputes
If a disagreement arises that we cannot resolve directly, either party can request mediation with an independent mediator agreed between us. If we cannot agree on a mediator within 14 days, or the dispute remains unresolved after 60 days of mediation, either party may refer the matter to the Australian courts. Mediation costs are shared equally, and mediation will take place in Brisbane, Queensland.
11. General terms
If we do not act on a breach of this policy straight away, that does not mean we have waived our right to act on it later. While we do not actively monitor everything on our site, we may do so, and may disclose information to relevant authorities or remove content we consider inappropriate.
Occasionally a price may be listed incorrectly due to a technical or human error. In that case, we are not obliged to honour the incorrect price, even if an order has already been placed. We are not liable for delays or failures caused by events outside our reasonable control.
This policy reflects our full understanding with you regarding these matters and replaces any earlier versions. It is governed by the laws of Queensland, Australia, and any dispute is subject to the exclusive jurisdiction of the Australian courts.
